Official Rules and Regulations
NO PURCHASE NECESSARY TO ENTER OR WIN. A purchase will not increase your chances of winning a prize in this Sweepstakes.
ELIGIBILITY: Sweepstakes open to legal U.S. residents of all ages residing in the continental United States, Alaska and Hawaii and Canada as of the start of the Sweepstakes and throughout the Sweepstakes period. Void in Puerto Rico and all other U.S. territories and possessions and where prohibited or restricted by law. The following individuals are not eligible to participate or win a prize in this Sweepstakes: (a) Employees and their immediate families or members of their households of BKN ("The Sponsor"), Warner Brothers Home Video, Majesco Entertainment, the Sponsor's agents, including advertising and promotional agencies, participating media or their affiliates, parent, subsidiary or related companies; (b) Individuals, including employees and their immediate families or members of their households, involved in the production or promotion of KONG: KING OF ATLANTIS or any other programming produced by BKN.
ENTRY: Please read carefully. Incomplete entries will be deemed void and not eligible to win a prize in this Sweepstakes.
To enter, log on to www.toymania.com and click the KONG: KING OF ATLANTIS icon. When completed, click the "SUBMIT" button to transmit your registration. Online entries must be received by 11:59 pm (ET) on January 31, 2006. Limit one online entry per person, household or email account per day. Postcard or mail-in entries will not be accepted, nor will entries not submitted in accordance with this Section.
ENTRANT'S RESPONSIBILITY: By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges that shall be final and binding in all respects. Failure to comply with these Official Rules may result in disqualification.
PRIZES: Fifty (50) winners of one each of the KONG: KING OF ATLANTIS DVD from Warner Brothers Home Video (Approximate retail value is $20.00) and one each of the KONG: KING OF ATLANTIS video game from Majesco Entertainment (Approximate retail value is $60.00). The approximate retail value of all prizes to be awarded is $3,500.
DRAWING: A random drawing will be held on or about Wednesday, February 22, 2006, at which time the potential prize winners will be selected from among all entries received by the end date of the Sweepstakes. If at the time of verification a potential winner is deemed ineligible, they will not be eligible to win a prize in this Sweepstakes. If prize is won by a minor under the age of eighteen (18) years of age, prize will be awarded in the name of the winner's parent or legal guardian.
ODDS: The odds of winning any prize in this Sweepstakes are dependent upon the number of eligible entries received. At no time shall the odds exceed a ratio that consists of a numerator exceeding the number one (1) and a denominator exceeding the total number of entries received during the Sweepstakes period.
INTERNET: If for any reason the Internet portion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the Sponsor or its agents that corrupts or affects the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft or destruction or unauthorized access to, or alteration of entries. The Sponsor is not responsible for any problems or technical malfunctions of any telephone networks or lines, computer on-line systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participating or downloading any materials in the Sweepstakes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. Entries made by Internet will be declared made by the authorized account holder of the e-mail address submitted at time of entry.
"Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
GENERAL: No prize(s) awarded in this Sweepstakes is (are) transferable nor may they be sold, refunded, commissioned, bartered or exchanged for cash value. Prizes will be sent to winners' home address only. Winners, or their parent or legal guardian (as applicable), will be required to execute and return a Notice of Acceptance, Affidavit of Eligibility, Liability Release, General Release, IRS Form W-9 (if required) and a Publicity Release (where lawful) within ten (10) calendar days of notification. Prize will be awarded in the name of parent or legal guardian, as required. If a selected winner is under the age of 13, and his or her selected entry originated through an electronic or online submission, written parental consent on a designated form is required in order for prize to be awarded. Failure to return all required documents will result in selected winner being disqualified and his/her prize will be forfeited and awarded to an alternate winner without exception.
If selected winner is unable to be contacted at the email address provided or by the telephone number(s) stated on their entry form, or if any prize notification or any prize is returned to Sponsor or Sponsor's fulfillment companies as undeliverable for any reason within thirty (30) days of original mailing, it will be awarded to an alternate winner, without exception.
The Sweepstakes sponsor, including its employees, promotional partners, advertising and promotional agencies, participating television stations or their affiliates, parent, subsidiary or related companies are not responsible for any delivery failures of prize notification to any potential winner(s) by email as a result of any filtering software, spam control, parental controls or restrictions or other related feature(s) installed on the accountholder or entrant's computer or user's email program that restricts or may restrict delivery of such notification.
By entering the KONG: KING OF ATLANTIS, each entrant, and his or her parent(s) or legal guardian, as applicable, accepts and agrees to be bound by these rules, and the decision of the Sponsor shall be final and binding in all respects. The Sponsor reserves the right to substitute any or all prize elements for others of equal or greater value for any reason. Only one prize will be awarded to any individual, family or address. All federal, state and local laws and regulations apply.
POLICY FOR ONLINE ENTRY: The collection of email information from persons under the age of 13 at the time of entry is made in accordance with the Children's Online Privacy Protection Act (COPPA). Submission of any email address will be used for the sole purpose of registering an entrant into the Sweepstakes. Information collected from entrants will be retained for the minimum period required by law. For entrants covered by COPPA statutes, use of such information shall be strictly limited to one-time contact of winning entrant(s) via the email address submitted on the electronic or online registration form for the purpose of confirming eligibility for participation in the Sweepstakes, notification of the selection of their entry and request for written parental consent and authorization to accept a prize. Failure by the entrant, or his/her parent(s) or legal guardian, to provide acceptance within ten (10) days of the send date will result in the entry being deemed ineligible, and no prize will be awarded to the selected entrant.
WAIVER: All participants waive the right to assert as a cost of winning any prize, any and all costs of verification and redemption or travel to redeem said prize, if applicable, and any liability that might arise from redeeming or seeking to redeem said prize. By participating in this promotion, all potential winners release BKN, prize providers and their respective employees and their agents, including advertising and promotion agencies, participating and affiliated media, their affiliates, parent and subsidiary companies, AND individuals, including employees and their immediate families or members of their households involved in the production or promotion of KONG: KING OF ATLANTIS or any related merchandise, from any and all liability with respect to participation in this Sweepstakes and acceptance of any merchandise or prize, and acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness.
TAXES: All prize winners shall be responsible for any and all federal, state or local income or excise taxes, or other associated costs, as applicable.
